Terms of Service

1. Agreement

By downloading, installing, or using MileAgent (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is provided by Fencing Pro Corp ("we," "us," or "our"), a company registered in Connecticut, USA.

2. What MileAgent does

MileAgent is an iOS application that automatically tracks vehicle trips for the purpose of tax mileage deductions. The App uses your iPhone's GPS and motion sensors to detect drives, calculates distances, and allows you to classify trips as business or personal. The App generates reports to help you claim mileage deductions on your tax returns.

3. Not tax advice

MileAgent is a tool, not a tax advisor.

The reports generated by MileAgent are based on the data you provide and the classifications you choose. We make no representations or warranties about the accuracy of your trip data, the correctness of your classifications, or whether any particular trip qualifies as a business expense under tax law.

You are solely responsible for:

• Verifying the accuracy of trip records before using them for tax purposes
• Correctly classifying trips as business or personal according to applicable tax law
• Consulting with a qualified tax professional about your specific situation
• Complying with IRS rules and any other applicable tax authority requirements

We are not responsible for any tax liability, penalties, audit outcomes, or other consequences arising from your use of MileAgent or the reports it generates.

4. Acceptable use

You agree to use MileAgent only for lawful purposes. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Falsify trip records to claim deductions you are not entitled to
• Attempt to reverse engineer, decompile, or modify the App
• Use the App in any way that could damage or impair its functionality

5. In-app purchases

MileAgent may offer optional paid features or subscriptions. All purchases are processed by Apple through the App Store and are subject to Apple's standard terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage subscriptions through your Apple ID settings.

Refunds are handled by Apple according to their refund policy. We do not process refunds directly.

6. Data accuracy

MileAgent relies on GPS and motion sensor data from your iPhone, which may be affected by signal quality, device settings, weather, or other factors. We make reasonable efforts to ensure accuracy but cannot guarantee that every trip is detected, logged, or measured with perfect precision. You should review your trip records and make corrections as needed.

7. Intellectual property

MileAgent, including all associated software, designs, text, graphics, and branding, is owned by Fencing Pro Corp and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal or business purposes. You may not copy, modify, distribute, or create derivative works based on the App.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FENCING PRO CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TAX DEDUCTIONS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

10. Termination

You may stop using MileAgent at any time by deleting the App from your device. We may terminate or suspend your access to the App at any time, for any reason, without notice.

11. Changes to terms

We may modify these Terms from time to time. We will notify users of material changes by posting the updated Terms here and updating the "Last Updated" date at the top. Continued use of the App after an update constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the state or federal courts located in Connecticut.
